    2. All Customers will be bound by any announcements made prior to the auction or a Lot on sale.
    3. Customers may not hold the seller(s), including GoBid, liable for interruption of their internet connectivity, and must keep their account details secure at all times. Please refresh your screen before the auction ends if you are using a mobile device, to ensure you have not lost connectivity.
    4. GoBid reserves the right to control and regulate bidding, and to withdraw an item or cancel a sale at any time.
    5. Timed Auctions may extend automatically as they are about to expire, based on recent bidding activity, or when the bid increment changes to allow all customers a fair opportunity to bid.
    6. Customers will not be allowed to bid against themselves unless their bid is under the reserve price. This is allowed in case you are the only bidder and you want to bid more to win the car.
    7. During the pre-bidding process, other bidders can bid against you. The highest pre-bid amount on any vehicle will be the starting bid for the Auctioneer on all auctions.
    8. The bidder of the highest accepted bid will be deemed to be the purchaser, except vehicles are sold Subject To Confirmation known as STC (where there is a reserve), which will be confirmed within two working days after the sale.
    9. Customers will be notified by e-mail if you have won any vehicles and a Sales Order will be generated where you are successful.
    10. All bids and purchases are final and cannot be cancelled by any Customer. Cancellation of any bids will be deemed a Breach of Sale.
  17. Invoicing and Payment Information
    1. You have 48 hours (two days) after an auction to finalise payment of your Sales Order (by Internet Banking / Cellphone Banking / Bank Transfer / ATM Transfer) and to upload / provide all the required documentation.
    2. Please confirm all your details on your Sales Order before making any payment, as these details will be used to create a final Tax Invoice. If you need us to invoice a company, please make sure your Sales Order is updated with us to a Company before making payment, we do not credit note and reinvoice sales in line with SARS legislation.
    3. GoBid banks with FNB. Please use the "Immediate Payment" function at your bank if you do not bank with FNB to avoid delays. Payment not made in full or documents not received in the required time may constitute a Breach of Sale. Please send your proof of payments for all purchases to pay@gobid.co.za
    4. Please use your CST number as a recipient reference for all payments. The system will auto allocate funds to your profile based on the CST reference you used when making payment(s). GoBid will not accept any losses or liability where the incorrect CST reference number is used.
    5. All Customer information uploaded on the website will first by verified by a GoBid employee before they will be invoiced. GoBid will not Invoice any Customer unless we have received the required documentation. Please also make sure you upload clear copies of documents where there are photos and identifying numbers.
    6. Once full payment has been made and allocated by our Finance Team, your Tax Invoice and Release Note will be emailed to you. You can also Download them on your secure GoBid Profile. You may then collect your vehicle from the branch. Partial payment will not entitle Customers to start the collection process.
    7. GoBid also accepts cash into our bank account, although it is not preferred, but if you choose by paying in cash, please note that a 2% cash handling fee will be charged on all cash deposits.
    8. Motor Salvage cannot be financed by a bank.
  18. Releasing / Collecting Vehicles
    1. Customers must have a Release Note in order to collect their vehicle from the Branch. Collection times are office hours (Monday to Friday 8am – 4pm) and excludes public holidays. We do not allow collections over weekends.
    2. All vehicles must be collected within 48 hours of your Release Note being issued. Failure to collect vehicles on time will result in additional storage fees of R150 (excluding VAT) per day being charged to the Customer before a vehicle can be released. Should any vehicle not be collected for a long period, and the storage exceed the sales price of the vehicle, GoBid reserves the right to sell the vehicle to recover storage costs.
    3. As vehicles are not yet registered and licensed on your name when a Tax Invoice and Release Note are generated, GoBid advises all Customers to send a towing operator of their choice to collect and deliver the car to you. The cost of transportation is for your own account. Please do not send Tow Trucks to collect vehicles until you have a Release Note.
    4. If you send a Tow Truck or third party to fetch your vehicle, please complete the relevant section on the Release Note emailed to you, and send the signed Release Note authorizing us to release your vehicle to the third party along with your ID and the third parties ID to the branch.
    5. GoBid cannot accept liability for damages as the result of vehicles being loaded onto any towing transport. GoBid is happy to assist in bringing the vehicle to the respective tow truck, but it is in fact their responsibility to load it, and consequently any damages should be for their account. Please make sure you deal with towing operators who have insurance.
    6. Vehicles left on our premises after auction are at the Customers risk, and no losses may be claimed against GoBid.
    7. Once a vehicle has left our premises, GoBid cannot be held liable for losses and the full risk and responsibility is now on the Customer. Collection of vehicles from our premises means the Customer has accepted the condition and details of the vehicle sold.
  19. Deposit Refunds
    1. In the event that a Customer is unsuccessful at purchasing any item for sale because they are outbid, or their bid is declined, they may Request Refund of their deposit, or request that we keep your deposit on your profile for you to purchase another vehicle. Refunds will be done in 5 to 7 working days, only after all the necessary documentation has been received.
    2. Please make sure you upload the following documents to avoid delays with your Refund:
      1. Copy of your ID
      2. Proof of Payment
      3. Proof of Banking Details
    3. GoBid takes the security of your money seriously and will not refund unless we have all of these documents. If you did not pay the money to our account, or want us to refund a third party, there is more documentation you must complete. Please contact us for information.
  20. Registration Papers / Logbook
    1. Change of Ownership (Registration Paper / Logbook) from GoBid to your name must be done within 21 days of your purchase as per the Road Traffic Act 1989.
    2. GoBid will complete Change of Ownership (which excludes licensing) for you, which is included in your Document Handling Fee. This process only begins when you collect your vehicle and takes about 7 working days.
    3. For change of ownership, you can choose between an RC1 or an RC2.
      1. We can give you an RC2 (Online Registration Release Letter), which is still change of ownership from our name to yours, and when completed, GoBid can send to you via email. The benefit of this option is that it is much quicker, and we suggest this as the best option for all our buyers. This option does not require you to submit certified copies of your documents to GoBid, and the documents you have already uploaded, or uncertified documents are accepted. It is important to note that this is not an RC1 (Original green Registration Paper / Logbook - Certificate of Registration in Respect of Motor Vehicle) and once you receive it, you will need to take it to your local Licensing authority along with a completed Blue Form (RLV) and your original documents (Citizens: ID and proof of address | Foreigners: Passport, Traffic Register and proof of address | Companies: BRNC / Traffic Register, Proxy ID, proof of business address) so that Licensing can print the original RC1 for you. GoBid also suggests that you take copies of your documents (as well as your originals) to Licensing, in case they require it to certify your original documents on site to avoid frustration and time delays.
      2. We can send you a RC1 (Original green Registration Paper / Logbook - Certificate of Registration in Respect of Motor Vehicle) via BEX Couriers. The downside to this is that we will need certified copies of your documents, and if the certification stamp is older than 3 months, you will need to keep resubmitting them to us. Licensing will not allow GoBid to print out RC1's on your behalf without certified copies of your documents. You can assist this process by uploading certified copies of your documents on your secure GoBid Profile. If you have submitted certified copies of GoBid to print you RC1 on your behalf, and the licensing office rejects your documents, GoBid will default your papers to the RC2 process as this is out of our control. You will then need to take your documents and RC2 to licensing to print out your RC1.
    4. Some vehicles may be marked as "Paper Delay". Please allow up to 10 business days for change of ownership.
    5. Some vehicles may be marked as "Subject to Clearance". Please request a copy of the NaTIS in order to complete a clearance on your vehicle and submit it to Licensing to remove the clearance requirement before we can complete Change of Ownership. Please send copies of your clearances to natis@gobid.co.za once you are done so we can proceed with your Change of Ownership.
    6. If you purchase a Code 3 to repair and use on the road, you must first repair your vehicle and get a Police Clearance before we can complete your Change of Ownership (in most cases). You must then take your Police Clearance to the Licensing office to remove the clearance status, and then inform GoBid. Licensing will reject change of ownership on Code 3 vehicles, unless the vehicle has been cleared. Once we have changed ownership, you will have to do a Roadworthy with your vehicle in order to get a license disc. This is for your account. Please send copies of your clearances to natis@gobid.co.za.
    7. If you have bought a Code 3 for stripping for parts, please complete the Code 3A Affidavit you received with your invoice. If you purchase a Code 3 for stripping for parts, GoBid will not refund the Document Handling Fee as we are still required to process multiple transactions prior to sale.
    8. When buying as a Company, GoBid will first attempt to dealerstock vehicles as “MD Stock” into your company name. If you are not open for dealerstocking, we will then do change of ownership into your company name as “Business Registration: Licensing liable” where licensing with be liable by you. GoBid will not accept liability for license fees owed by you the Licensing Authorities.
    9. If change of ownership is rejected due to (1) the company not being open for dealerstocking, or (2) the incorrect Proxy information being given to GoBid, the Customer will be liable for delays.
    10. Customer not in possession of a driver's license must first go to their local licensing authority with their ID and ask to be "Introduced on the Natis system". Delays in change of ownership due to purchasers not being on Natis are the sole responsibility of the purchaser.
    11. Registration Papers / Logbooks will only be given to the purchaser, unless they have sent a letter authorising us to release the Registration Papers to a third party.
    12. Any fines received on sold vehicles whilst Change of Ownership is in progress will be transferred to your account.
    13. The date of first registration on your Registration Papers / Logbooks is not always the year model.
    14. Licensing fees must be paid by the Customer to the licensing authorities.
    15. Failure to change ownership by GoBid due to delays caused by you will result in your GoBid account being blocked.
  21. Breach of Sale
    1. GoBid reserves the right to take 10% of your Sales Order total to a maximum of your GoBid deposited amount as a penalty for any Breach of Sale.
    2. If a Customer has paid for their vehicle (Tax Invoice generated), the sale is final and cannot be cancelled by the Customer. In this case, the Customer has the option to sell their vehicle on the GoBid website as consignment without reserve.
  22. General

    6. GoBid does not have agents working for us, and we will not give special discounts to people who may then pass them onto you. GoBid also does not issue sales agreements and will never ask for a deposit (other than the R5 000 auction deposit) to secure any vehicle. Be aware of scammers and only pay money to GoBid's account. GoBid will never ask you to pay a third party.
    7. For all purposes, including litigation, relating to and arising from these Terms and Conditions, the Customer determines as his/her Domicilium Citandi et Executandi the address given by him/her at the time of registration and which is accepted by the registered user.
